Congress established the Osage reservation in Oklahoma Territory in 1872. Years later, “mammoth reserves of oil and gas” were found. Congress severed the subsurface mineral estate, reserved it to the tribe, and placed it into trust with the federal government as trustee. Royalties are distributed to tribal members listed on an approved membership roll (a headright).In previous litigation, the Claims Court found the tribe had standing and found the government liable for breaching its fiduciary duties by failing to collect the full amount of royalties and failing to invest the royalty revenue. Individual headright owners (not the present plaintiffs) attempted to intervene. The Claims Court found that the individuals had no legal interest in the dispute because they were not a party to the trust relationship. The $380 million settlement agreement stated that the tribe, “on behalf of itself and the [h]eadright [h]olders,” waived any claims relating to the tribe’s trust assets or resources that were based on violations occurring before September 30, 2011. In a federal suit, filed by individual headright owners, the Tenth Circuit held that headright owners had a trust relationship with the federal government, which was ordered to provide an accounting.In 2019, based on allegations that the accounting revealed mismanagement of the trust fund, headright owners filed the present suit under the Tucker Act and the Indian Tucker Act, citing breach of statutorily imposed trust obligations. The Federal Circuit reversed the dismissal of the suit. A trust relationship exists between the headright owners and the government and the 1906 Act imposes an obligation on the federal government to distribute funds to headright owners in a timely and proper manner. The Sault Ste. Marie Tribe of Chippewa Indians purchased the Sibley Parcel with interest from its Self-Sufficiency Fund and sought to have the land taken into trust by the Department of the Interior with a view to establishing gaming operations. The Tribe claimed the Parcel was acquired for the “enhancement of tribal lands,” a permitted use of Fund interest under the Michigan Indian Land Claims Settlement Act Section 108(c). Interior concluded that the mere acquisition of additional land was not an “enhancement” and declined to take the Parcel into trust because the Tribe failed to demonstrate how the Parcel would improve or enhance tribal lands. The land is in Michigan’s Lower Peninsula far from the Tribe’s existing lands in the Upper Peninsula.The district court granted summary judgment to the Tribe. The D.C. Circuit reversed. Under the plain meaning of the Michigan Act, before assuming a trust obligation, The Department has the authority to verify that the Tribe properly acquired the land with Fund interest, consistent with the limited uses for such interest in Section 108(c). In exercising that authority, The Department correctly determined that “enhancement of tribal lands” does not include an acquisition that merely increases the Tribe’s landholdings. The grandmother of an Indian child was appointed as the child’s guardian. The Office of Children’s Services (OCS) took emergency custody of the child after the grandmother admitted using methamphetamine and the child tested positive for the drug. After working with the grandmother to address her drug use and other issues, OCS petitioned to terminate the grandmother’s guardianship. Following a hearing, the superior court found that termination of the guardianship was in the child’s best interests and removed the grandmother as guardian. The grandmother appealed, arguing that her removal violated the Indian Child Welfare Act (ICWA) and that termination of the guardianship was not in the child’s best interests. Finding no reversible error, the Alaska Supreme Court affirmed the superior court’s removal of the grandmother as guardian. The issue this case presented centered on the aftermath of an Indian tribal casino’s unsuccessful suit in tribal court against appellant James Acres following a contract dispute. After dismissal of the tribal case, Acres filed his own suit in state court against two officials of the casino, the casino’s attorneys, a tribal court judge, the clerk of the tribal court, and various other individuals and entities. He alleged, among other things, that the parties he sued (collectively, respondents) wrongfully conspired to file the lawsuit against him in tribal court. He then sought monetary relief from respondents as redress for this alleged conduct. The trial court, however, found Acres’s claims against all respondents barred by sovereign immunity and, as to the tribal judge and several others, also barred by judicial or quasi-judicial immunity. On appeal, the Court of Appeal reversed in part. Because Acres’s suit, if successful, would bind only the individual respondents, and not the tribe or its casino, the Court found those respondents were not entitled to sovereign immunity. But, as to those respondents who asserted personal immunity from suit (e.g., judicial immunity), the Court agreed those respondents, with one exception, were immune from suit. View "Acres v. In this appeal following the termination of parental rights, the mother contended only that the social services agency failed to comply with the duty of initial inquiry imposed by state statutory provisions implementing the Indian Child Welfare Act of 1978. The social services agency concedes error but argues that it was harmless. The Court of Appeal determined the agency failed to investigate readily obtainable information tending to shed meaningful light on whether a child was an Indian child, found the error prejudicial and conditionally reversed. "If, after completing the initial inquiry, neither CFS nor the court has reason to believe or to know that Benjamin is an Indian child, the order terminating parental rights to Benjamin shall be reinstated. The Eighth Circuit affirmed the district court's judgment declaring that the United States has a duty to provide "competent physician-led healthcare" to the Rosebud Sioux Tribe and its members. In light of the promises the United States made to the Tribe more than 150 years ago in the Fort Laramie Treaty, and relevant legislation since that time, such as the Snyder Act and the Indian Health Care Improvement Act, the district court correctly articulated the existence and scope of the duty and declaratory judgment was proper. L.B. lived within the Northern Cheyenne Reservation. L.B. and her mother went to a bar and had alcoholic drinks. After they returned home, L.B.’s mother went for a drive. L.B. called the police and reported that her mother was driving while intoxicated. Bureau of Indian Affairs (BIA) Officer Bullcoming determined that L.B.’s mother was safe and then went to L.B.’s residence, where her children were asleep in the other room. L.B. admitted to consuming alcoholic drinks. Bullcoming threatened to arrest L.B. for child endangerment because she was intoxicated while in the presence of her children. L.B. pleaded with Bullcoming not to arrest her because she would lose her job as a school bus driver. Bullcoming took L.B. outside for a breathalyzer test. L.B. believed that her choices were to go to jail or have sex with Bullcoming. L.B. and Bullcoming had unprotected sexual intercourse. L.B. became pregnant as a result of the encounter and gave birth.L.B. brought a Federal Tort Claims Act suit, seeking to hold the government liable for Bullcoming’s misconduct. The government asserted that Bullcoming was not acting within the scope of his employment when he sexually assaulted L.B so his actions fell outside the scope of the FTCA’s limited waiver of sovereign immunity. The Ninth Circuit certified the question to the Montana Supreme Court: whether, under Montana law, OBullcoming’s sexual assault of L.B. was within the scope of his employment as a law enforcement officer. The Ninth Circuit affirmed the district court's dismissal of a Federal Tort Claims Act (FTCA) case brought by plaintiffs, alleging negligence by an emergency room physician. The physician treated Tyrone Sisto at the San Carlos Apache Healthcare Corporation hospital and failed to diagnose Rocky Mountain Spotted Fever. Plaintiffs claimed that the physician was an "employee of the United States" under the FTCA and the Indian Self-Determination and Education Assistance Act (ISDEAA), 25 U.S.C. 5301 et seq., and that he negligently failed to diagnose the disease that led to Sisto's death.The panel agreed with the district court that the FTCA and section 5321(d) do not waive the United States' sovereign immunity with respect to claims based on the negligence of employees of independent contractors providing health care pursuant to a self-determination contract under the ISDEAA. Therefore, the panel concluded that the physician was an employee of T-EM rather than the hospital, and that the FTCA and section 5321(d) do not authorize a suit against the United States based on his alleged negligence. In this case, the physician had only a contract with T-EM and he was not an individual who provided health care services pursuant to a personal services contract with a tribal organization and was therefore not an employee of the Public Health Service under section 5321(d); because hospital privileges were not issued to the physician on the condition that he provide services covered by the FTCA, neither 25 U.S.C. 1680c(e)(1) nor 25 C.F.R. 900.199 confers FTCA coverage; and the hospital did not control the physician's actions in administering care to a degree or in a manner that rendered him an employee of the government when he treated Sisto. A member of the Metlakatla Indian Community was convicted of several commercial fishing violations in State waters and fined $20,000. He appealed his conviction and sentence to the court of appeals, which asked the Alaska Supreme Court to take jurisdiction of the appeal because of the importance of the primary issue involved: whether the defendant’s aboriginal and treaty-based fishing rights exempted him from State commercial fishing regulations. The defendant also challenged several evidentiary rulings and the fairness of his sentence. Because the Supreme Court held the State had authority to regulate fishing in State waters in the interests of conservation regardless of the defendant’s claimed fishing rights, and because the Court concluded the trial court did not abuse its discretion in its procedural rulings, the Supreme Court affirmed the conviction. The Court also affirmed the sentence as not clearly mistaken, except for one detail on which the parties agreed: the district court was mistaken to include a probationary term in the sentence. The superior court terminated a father’s parental rights to his two children after finding them children in need of aid because of their father’s domestic violence and aggressive behavior. The children were Indian children under the Indian Child Welfare Act (ICWA). Therefore the Office of Children’s Services (OCS) was required to make active efforts to provide remedial services and rehabilitative programs designed to prevent the breakup of the family. At the termination trial, the superior court found clear and convincing evidence that OCS made active efforts but that these efforts proved unsuccessful. The father appealed, arguing only that the superior court’s active efforts finding was made in error. Finding no reversible error, the Alaska Supreme Court affirmed the termination order.
