The Supreme Court vacated the judgment of the intermediate court of appeals (ICA) affirming the circuit court's order affirming the final decision of the Employees' Retirement System (ERS) Board and dismissing Appellant's appeal, holding that Appellant was entitled to present argument on his exceptions to the ERS Board and to have the Board consider the merits of his exceptions.The ERS denied Appellant's application for service-connected disability retirement benefits after suffering a back injury. ERS subsequently received a document filed by Appellant entitled "Petitioner's Proposed Decision." The ERS Board later issued a final decision concluding that Appellant's filing did not constitute exceptions and confirmed its denial of his application. On appeal, Appellant argued that the ERS Board's proposed decision did not automatically become a final decision because he had timely filed exceptions. The circuit court and ICA affirmed. The Supreme Court remanded this case to the ERS Board for further proceedings, holding that Appellant's "Petitioner's Proposed Decision" filing satisfied the standard for exceptions and that Appellant was entitled to present argument on his exceptions. The Supreme Court affirmed the order of the Nebraska Workers' Compensation Court on remand appointing an employee's "Form 50" physician and clarifying that it was not ordering a review of the employee's treatment regimen, holding that the order complied with this Court's mandate.Employee injured her back in the course and scope of her employment. As part of a settlement between Employee and her employer and its insurer (collectively, Employer), Employee completed a Form 50 anticipating that Employer would pay for treatment of Employee's injuries by her Form 50 physician. Employee chose a Nebraska doctor to serve as her Form 50 physician, but when she moved to Florida, she informed Employer that she had chosen a Florida doctor as her new Form 50 physician. Employer subsequently stopped paying for Employee's treatment. The compensation court ordered Employer to pay Employee's medical bills. The Supreme Court reversed, ruling that Employer was not required to pay for Employee's Florida medical treatment because Employee had not followed the statutory procedures to change her Form 50 physician. On remand, the compensation court appointed the Florida doctor as Employee's Form 50 physician. The Supreme Court affirmed, holding that the compensation court did not err in its order on remand. In this workers compensation case, the Supreme Court reversed the judgment of the court of appeals holding that Kan. Stat. Ann. 44-510e(a)(2)(B) was unconstitutional on its face, holding that the statute is constitutional.Appellant was injured during his employment and filed for workers compensation benefits. A doctor rated Appellant's permanent partial impairment using the Sixth Edition of the American Medical Association Guides, as adopted by the Kansas Workers Compensation Act. See section 44-510e(a)(2)(B). The court of appeals reversed, holding that the statute's use of the Sixth Edition was unconstitutional on its face because it changed the essential legal standard for determining functional impairment. The Supreme Court reversed after construing the ambiguous statutory language to avoid the constitutional question, holding that the language of section 44-510e(a)(2)(B) referencing the Sixth Edition can reasonably be interpreted as a guideline rather than a mandate. The Supreme Court reaffirmed in this case that undocumented aliens who are injured while working for a Nevada employer may be eligible for monetary disability benefits, holding that these monetary benefits, paid by the insurer, do not conflict with federal law or undermine the Legislature's intent.Respondent, an undocumented Nevadan, was severely injured while working for High Point Construction and applied for permanent total disability (PTD) status. Associated Risk Management (ARM), High Point's insurance administrator, denied the request. An appeals officer reversed and granted Respondent PTD status pursuant to the "odd-lot doctrine." ARM petitioned for judicial review, arguing that the appeals officer committed legal error by granting PTD to an undocumented alien. The Supreme Court affirmed, holding (1) undocumented aliens are not precluded from receiving disability benefits under Nevada's workers' compensation laws; (2) although federal law prohibits employers from knowingly employing an undocumented alien, it does not prohibit insurers from compensating undocumented aliens for injuries they sustain while working; and (3) the appeals officer's decision was based on substantial evidence. The Supreme Judicial Court affirmed the opinion of the Workers' Compensation Board Appellate Division agreeing with the conclusion of the administrative law judge (ALJ) that Darla Potter, an aquaculture worker, was not a "seaman" within the meaning of the Jones Act, 46 U.S.C.S. 30104, holding that the Appellate Division did not err.The Appellate Division affirmed the decree of the ALJ granting Potter's petitions for award of compensation for injuries sustained in the course of her employment with Cooke Aquaculture USA, Inc. At issue on appeal was whether Potter's claims fell within the jurisdiction of federal admiralty law or state workers' compensation law. In 2018, N.G. submitted a proposed claim for damages to the County, alleging that San Diego County Deputy Sheriff Richard Fischer sexually assaulted her in 2017. N.G. acknowledged the claim was submitted 81 days after the six-month period for filing a claim expired. N.G.’s petition for relief alleged that due to the emotional trauma and psychological difficulties faced by victims of sexual assaults committed by law enforcement officers, which could cause those victims to delay in coming forward, her failure to file a timely claim should have been excused due to mistake or excusable neglect. Accordingly, N.G. also filed an application for leave to file a late claim. The County denied leave to file a late claim; N.G. appealed when the district court denied her petition under Government Code section 946.6 seeking relief from the requirement in the Government Claims Act that she timely file a claim with the County of San Diego prior to bringing a suit for damages. The Court of Appeal concluded the trial court was within its discretion to conclude that N.G. did not establish mistake or excusable neglect to support her petition for relief from the claim filing requirement. In these consolidated appeals arising from Kenneth Skahan's claims for workers' compensation benefits against his former employer and its insurance carrier (collectively, Employer), the Supreme Court vacated in part the judgments of the intermediate court of appeals (ICA) affirming Labor and Industrial Relations Appeals Board's (LIRAB) decisions, holding that the ICA erred in part.Skahan injured his back while working for Employer, and Employer accepted workers' compensation liability. After Skahan's employment with Employer ended, he experienced mid and low back pain and was diagnosed with diffuse idiopathic skeletal hyperostosis (DISH) and filed multiple claims for additional workers' compensation benefits. LIRAB determined that Skahan's DISH injury was compensable because it was causally related to his work injury but that his low back injury was not compensable. The ICA affirmed. The Supreme Court vacated in part, holding (1) the ICA erred in holding that Employer rebutted the Haw. Rev. Stat. 386-85 presumption that Skahan's low back claim was for a covered work injury; (2) LIRAB's finding that Skahan's injury was permanent and stationary and at maximum medical improvement by April 19, 2013 was clearly erroneous; and (3) LIRAB's conclusion of law ending Skahan's temporary total disability benefits on April 19, 2013 was clearly erroneous. Kevyn Menges suffered catastrophic injuries in a motor vehicle accident. Menges, through her guardian ad litem Susan Menges, sued the Department of Transportation (Caltrans) for its negligent construction of an interstate off-ramp. Caltrans moved for summary judgment, asserting design immunity. The trial court granted Caltrans’s motion for summary judgment. On appeal, Menges argued: (1) design immunity should not have applied since the approved plans were unreasonable, and the construction of the interstate off-ramp did not match the previously approved design plans; (2) the trial court erred in denying her oral request for a continuance at the summary judgment hearing; and (3) Caltrans’s Code of Civil Procedure section 998 offer was unreasonable and invalid, and a portion of the cost award for expert witness fees should have been disallowed. A worker died at a construction site when a retaining wall collapsed. Neither the putative employer, who claimed the worker was an independent contractor, nor the property owner, who hired the putative employer, had workers’ compensation coverage. The worker’s mother, who also was the personal representative of the worker’s estate, filed both a workers’ compensation claim against the Alaska Workers’ Compensation Benefits Guaranty Fund and a superior court wrongful death action against both the putative employer and the property owner. The Fund later caused the property owner, the putative employer, and the worker’s father to be joined as parties to the workers’ compensation claim before the Alaska Workers’ Compensation Board.All parties to the workers’ compensation proceeding, except the putative employer, entered into a settlement agreement; in the settlement the estate elected the wrongful death suit as its remedy, agreed to dismiss the workers’ compensation claim entirely to effectuate its remedy election, received a settlement payment from the property owner’s general liability insurer, and dismissed the wrongful death claim against the property owner. The agreement explicitly preserved the estate’s wrongful death claim against the putative employer. The Board approved the agreement, and the superior court dismissed the property owner from the wrongful death action based on a separate stipulation. The putative employer then sought dismissal of the wrongful death suit, contending that the Alaska Workers’ Compensation Act’s exclusive liability provision precluded the lawsuit because the settlement effectively paid workers’ compensation benefits to the estate. The superior court granted the putative employer summary judgment, relying on the Act to decide that the Board’s approval of the settlement transformed the settlement money into workers’ compensation benefits. Because the superior court misinterpreted the settlement agreement and the Act, the Alaska Supreme Court reversed the grant of summary judgment and remanded for further proceedings. View "Seal v.
