Thimon, 14 years old, was crossing Cherry Street in Newark, when she was hit by a car driven by Soudachanh. Thimon was seriously injured and sued the city, asserting that the intersection lacked any mechanisms to alert a driver of a pedestrian’s use of the crosswalk and noting the “forced use of an unprotected, uncontrolled crosswalk particularly at a time of year and time of day when glare from the morning sun obscures visibility of pedestrians” for more than four lanes of commuter traffic traveling at 45 mph.The court of appeal affirmed summary judgment in favor of the city. The court noted Soudachanh’s negligence in continuing to drive, despite being blinded by glare; a public entity is not required to assume that third parties will act negligently. Newark presented evidence regarding each of Thimon’s allegedly dangerous features. A study by a consulting company conducted shortly after the accident, based on the California Manual on Uniform Traffic Control Devices, concluded a traffic signal was not warranted. Thimon did not explain how Newark’s painting of lines demarcating the crosswalk, with signs warning motorists of the pedestrian crossing, “increased or intensified” the risk of injury. The lack of any similar collisions over 10 years preceding the accident indicated that Thimon’s injury was caused entirely by the driver's negligence and not by any dangerous condition of public property. Workforce Safety and Insurance (WSI) appealed a district court judgment reversing an Administrative Law Judge's (ALJ) confirmation of a prior order of WSI. In 2014, Ellis began receiving partial disability benefits. In 2016, Ellis underwent a functional capacity assessment and further review by WSI. WSI determined Ellis continued to be eligible to receive partial disability benefits, but at a reduced amount. WSI ordered his partial disability benefits be reduced by the greater of his actual wages or his retained earning capacity as had been determined by WSI. Ellis appealed the WSI order, triggering review by the ALJ. WSI contended the district court lacked subject matter jurisdiction over Ellis’ appeal of the ALJ’s decision because his appeal to the district court was untimely. The North Dakota Supreme Court found the district court lacked subject matter jurisdiction because Ellis failed to timely file his appeal of the ALJ's decision. Farid Hedayatzadeh (Hedayatzadeh) appealed following the trial court's summary judgment in favor of the City of Del Mar (the City) in his lawsuit arising out of the death of his 19-year-old son, who was struck by a train on an oceanfront bluff in Del Mar on property owned by North County Transit District (NCTD). Specifically, Hedayatzadeh argued the trial court erred in granting summary judgment on his single cause of action alleging a dangerous condition of public property based primarily on the City's failure to erect any barriers to prevent pedestrians from accessing NCTD's train tracks. On the night at issue, Javad Hedayatzadeh and his friends walked around the guardrail at the end of 13th Street, down an unimproved dirt embankment, and crossed the train tracks. The group then walked northbound on the west side of the tracks to a spot where they sat and smoked marijuana. They knew they were trespassing on NCTD property. At various points along the railroad right-of-way, NCTD has installed signs stating "No Trespassing," "Danger" and "Railroad Property." Javad noticed a freight train coming from the south and told his friends that he was going to use his phone to take a video "selfie" of himself next to the train. As Javad was near the train tracks taking the selfie, he was struck by the train and killed. After filing an unsuccessful claim under the Government Claims Act, Javad's father, Hedayatzadeh, filed this lawsuit against the City, NCTD, and BNSF Railway Company, which allegedly operated the freight train. The Court of Appeal concluded that, as a matter of law, the City's property at the end of 13th Street did not constitute a dangerous condition of public property even though the City did not take action to prevent pedestrians from accessing the train tracks on NCTD's adjacent right-of-way by walking around the guardrail at the end of the street. The Supreme Court affirmed the order of the circuit court affirming the decision of the Department of Labor determining that Appellant's knee surgery and related treatment were not compensable, holding that the Department did not err when it concluded that Appellant's work-related injury, in combination with his preexisting condition, did not remain a major contributing cause of his disability, impairment, or need for treatment.Appellant injured his left knee while working for Appellee. Appellee denied liability for Appellant's total knee replacement surgery and post-operative treatment. The Department found the work-related injury neither contributed independently nor was a major contributing cause of Appellant's need for surgery. The circuit court affirmed. The Supreme Court affirmed, holding that Appellant failed to prove causation under either S.D. Codified Laws 62-1-1(7)(b) or S.D. Codified Laws 62-1-1(7)(c). View "Armstrong v. The Fifth Circuit affirmed the district court's dismissal, based on lack of subject matter jurisdiction, of plaintiff's action under the Federal Tort Claims Act (FTCA) and the Anti-Terrorism Act (ATA). Plaintiff, a security guard, was shot in the leg while on duty by a pair of Islamic terrorists.The court held that plaintiff failed to satisfy the first prong of the discretionary function analysis, because he failed to point to a specific, nondiscretionary function or duty that prescribes a specific course of action for an agency or employee. The court also held that plaintiff waived his argument that a certain gun sale contravened the FBI's express policy prohibiting the sale of firearms to suspected terrorists, because plaintiff failed to adequately brief the issue. Likewise, plaintiff's argument regarding the law enforcement proviso was waived.The court declined to adopt the state created danger doctrine to overcome the FTCA's discretionary function exception; held that the district court properly dismissed the ATA claims for lack of subject matter jurisdiction; and held that the district court did not abuse its discretion by barring additional discovery. Following the death of Patricia Lewis (Worker), her widower Michael Lewis (Petitioner) was awarded death benefits under the Workers’ Compensation Act. The Workers’ Compensation Judge (WCJ) based the award on the finding that Worker, while employed with Albuquerque Public Schools (Employer), contracted allergic bronchopulmonary aspergillosis (ABPA) which proximately resulted in Worker’s death. Employer appealed the award to the Court of Appeals. Pertinent here, the appellate court concluded: (1) the WCJ correctly rejected Employer’s argument that Petitioner’s claim for death benefits was time-barred; and (2) he WCJ erred in excluding from evidence certain medical testimony and records which Employer contended related to Worker’s cause of death. The Court of Appeals therefore remanded the case for retrial on whether Worker’s ABPA “‘proximately result[ed]’” in her death. On the first issue, the New Mexico Supreme Court agreed with the Court of Appeals that Petitioner’s claim for death benefits was not time-barred, and affirmed. On the second issue concerning the WCJ’s exclusion of medical testimony and evidence on Worker’s cause of death, the Supreme Court held the Court of Appeals erred in its interpretation of Section 52-1-51(C), but agreed based on the Supreme Court's own interpretation of Section 52-1-51(C) that the case had to be remanded for further proceedings. Ammons and Riley sued Wisconsin Central under the Federal Employers’ Liability Act (FELA), 45 U.S.C. 51, for injuries they sustained when the train they were operating struck another train. Both alleged Wisconsin Central was negligent in violating various rules and regulations, which resulted in their injuries. Wisconsin Central alleged that plaintiffs failed to exercise ordinary care and that multiple locomotives, railroad cars, track, and track structures sustained significant damage, which caused it to spend significant amounts of money to repair, perform environmental cleanup and remediation, and incur other incidental and consequential damages. Wisconsin Central sought damages in excess of $1 million.Section 55 of the FELA prohibits “[a]ny contract, rule, regulation, or device whatsoever, the purpose or intent of which shall be to enable any common carrier to exempt itself from liability.” Section 60 prohibits “[a]ny contract, rule, regulation, or device whatsoever, the purpose, intent, or effect of which shall be to prevent employees of any common carrier from furnishing voluntarily information to a person in interest as to the facts incident to the injury or death of any employee.” Plaintiffs argued that Wisconsin Central’s counterclaims constituted a “device” designed to exempt itself from liability to pay damages to injured employees, to deter railroad employees from providing information regarding injury or death of an employee, or both.The Illinois Supreme Court held that the counterclaim was not prohibited, citing the employer’s long-standing right to sue its employees for negligence, the statute's plain language, and federal court decisions. Unlike a contractual agreement or a release, a counterclaim does not extinguish a plaintiff’s FELA cause of action or exempt the railroad employer from liability. View "Ammons v. The Metropolitan Water Reclamation District entered into a contract with the Joint Venture, for the “Primary Settling Tanks and Grit Removal Facilities” project to be carried out at the Calumet water reclamation plant. Under the contract, the Joint Venture was responsible to determine the procedures and methods for the work and furnish all temporary structures and safety equipment and was responsible for the safety of all personnel on the worksite. The contract required the Joint Venture to submit plans for the work to the District’s engineer but state that the engineer’s acceptance of the plans did not relieve the Joint Venture of its responsibility for safety, maintenance, and repairs on the project. Andrews, a Joint Venture employee, suffered severe, career-ending head injuries while working on the project.In a suit alleging construction negligence, willful and wanton construction negligence, and loss of consortium, the District alleged immunity under the Local Governmental and Governmental Employees Tort Immunity Act (745 ILCS 10/2-109, 2-201). The Illinois Supreme Court concluded that the District was not entitled to summary judgment of immunity. The Act immunizes a local governmental entity from liability for injuries arising out of its employee’s acts or omissions while determining policy and exercising discretion. The District did not provide evidence that its employees made discretionary or policy decisions with respect to the two-ladder configuration that resulted in Andrews’s injuries. The Supreme Court affirmed in part and quashed in part the final decree of the Workers' Compensation Court (WCC) upholding an award of accidental disability benefits for occupational cancer to Petitioner, holding that the WCC had jurisdiction to hear Petitioner's appeal but erred in finding that R.I. Gen. Laws 45-19.1-1 contains a conclusive presumption that all cancer in firefighters is occupational cancer.Petitioner served as a firefighter for the City of Cranston until he was diagnosed with colon cancer. Petitioner applied for accidental disability benefit based upon his cancer diagnosis. The Retirement Board of the Municipal Employees' Retirement System of Rhode Island denied the application, finding that Petitioner did not prove that his cancer arose out of and in the course of his employment as a firefighter. The WCC then filed his petition arguing that, pursuant to chapter 19.1 of title 45, all cancers contracted by firefighters are presumed to be work-related. The trial judge agreed and reversed the board. The Supreme Court quashed the decree in part, holding that chapter 19.1 of title 45 does not contain any presumption that all cancers in firefighters are occupational cancers. View "Lang v. Riley was riding a motorcycle through a green light in Oakland, when he was struck by a car fleeing from Sheriff’s deputies in marked cars. The suspects in the car that struck Riley were suspected of theft and the car had been reported as stolen. Riley traveled on the hood of the car for some distance, until the car crashed. Riley suffered serious bodily injury. Riley filed suit. Defaults were entered against the suspects. The court dismissed the individual officers from the action and later granted the Sheriff summary judgment, concluding the Sheriff is entitled to immunity under Vehicle Code section 17004.7, which provides a public agency immunity from liability for collisions involving vehicles being pursued by peace officers if the agency “adopts and promulgates a written policy on, and provides regular and periodic training on an annual basis for, vehicular pursuits.” The court of appeal affirmed. The Oakland Policy does effectively “control and channel the pursuing officer’s discretion” in determining the speed of pursuit. The Sheriff showed that deputies were trained in accordance with the Policy and that the training included adequate consideration of speed limits as required by Penal Code section 13519.8(b).
