Graham v. D&K Oilfield Services
A workers' compensation claimant suffered a hernia and recurrent hernia due to work. He requested a contested hearing on the constitutionality of the hernia provision of the Administrative Workers' Compensation Act, 85A O.S. Supp. 2013 section 61. An administrative law judge determined 85A O.S. Supp. 2013 sec. 61 to be constitutional. Claimant appealed. The Workers' Compensation Commission affirmed the determination of the administrative law judge. The question presented for the Oklahoma Supreme Court's review was whether the hernia provision was unconstitutional because: (1) it violated the due process rights of claimants guaranteed by U.S. Const. amend. XIV, sec. 1 and Okla. Const. art. 2, sec. 7; (2) it was a special law prohibited by Okla. Const. art. 5, sec. 46; and (3) it failed to provide an adequate remedy for a recognized wrong, in violation of Okla. Const. art. 2, sec. 6. The Supreme Court answered in the negative. However, in light of it's opinion in Corbeil v. Emricks Van & Storage, 2017 OK 71, ___ P.3d ___, this case was remanded for further proceedings concerning the application of 85A O.S. Corbeil v. Emericks Van & Storage
Petitioner Lyle Corbeil suffered bilateral inguinal hernias at work, filed for workers' compensation benefits, and asked for a contested hearing on the issue of temporary total disability. The administrative law judge determined that petitioner was limited to six weeks of temporary total disability, despite petitioner's contention he suffered two hernias and should have been eligible for twelve weeks total (six for each hernia). Petitioner appealed to the Workers' Compensation Commission, which affirmed the administrative law judge. The question presented for the Oklahoma Supreme Court's review was whether the hernia provision of the Administrative Workers' Compensation Act (AWCA), 85A O.S. Supp. 2013 section 61, permitted an award of up to six weeks of temporary total disability (TTD) for each hernia suffered by a claimant, regardless of whether the hernias occurred, or were repaired, simultaneously. Estate of Ware v. Hospital of the University of Pennsylvania
Jeffrey Ware, Ph.D., was a University of Pennsylvania neuroscientist, studying the effects of radiation on biological organisms with the goal of better understanding how radiation affects astronauts while in orbit. Ware used cesium-137 irradiators to track the effects of low-level radiation on mice and rats. In 2010, Ware suffered a rare form of brain cancer, gliosarcoma. His widow, Boyer, claims gliosarcoma is associated with radiation exposure but produced no expert reports and that Ware’s cancer specifically resulted from radiation exposure that UPenn failed to properly monitor, protect against or warn of. Ware underwent chemotherapy and radiation at the University’s hospital. Boyer alleges that Ware was not given appropriate information about these treatments; that, given the advanced stage of his disease, they provided little benefit; and that a UPenn doctor enrolled Ware in a research study to investigate the effects of chemotherapy and radiation on brain cancer patients without his knowing consent. The Third Circuit affirmed the application of the Price-Anderson Act, 42 U.S.C. 2011, and its remedy-limiting provisions to Boyer's suit. The Act gives federal courts jurisdiction to resolve a broad set of claims involving liability for physical harm arising from nuclear radiation. Boyer’s case is within the Act’s reach. Jovanov v. Dept. of Corrections
In 2010, Corrections Officer Nelson Robinson was supervising a prison module of about 50 inmates at the Anchorage Correctional Complex, including Radenko Jovanov and Alando Modeste. Modeste approached Jovanov while he was in line for the telephone, and he told Jovanov that he wanted them to request placement in separate modules because Modeste was related by marriage to the victim of Jovanov’s crime. Modeste then punched Jovanov on the left side of the head and pushed his head into the wall, requiring Jovanov to obtain medical treatment for his injuries. Jovanov sued the Department of Corrections (DOC), Officer Robinson, and Modeste for his injuries, alleging: (1) the assault was foreseeable and therefore DOC should have prevented it; (2) Officer Robinson failed to respond promptly to the argument and prevent further injury to Jovanov; and (3) DOC was negligent in understaffing the prison unit and placing the officer’s desk out of view of the telephone. DOC counterclaimed for the cost of the medical treatment Jovanov received. The superior court granted summary judgment in favor of Jovanov against Modeste on the issue of liability, and in favor of DOC’s counterclaim for medical costs. The Alaska Supreme Court affirmed the superior court’s decision granting summary judgment in favor of DOC on Jovanov’s negligence claims against it; the assault was not foreseeable, and therefore DOC cannot be negligent on these grounds. Further, DOC’s staffing decisions and its placement of the guard’s duty station were immune policy decisions that could not form the basis of a negligence claim. The Supreme Court reversed the superior court’s grant of summary judgment in favor of DOC on its counterclaim against Jovanov for the cost of medical care provided to him and remand for further proceedings. State ex rel. Camaco, LLC v. Albu
An employer does not face liability for the violation of a specific safety requirement (VSSR) when it lacked knowledge of a specific danger requiring a safety device.Employee suffered a head injury while working for Employer. The Industrial Commission awarded workers’ compensation benefits and granted an additional award to Employee based upon its finding that Employer had violated a specific safety requirement in failing to provide Employee with protective headgear. Employer filed a mandamus action in the court of appeals challenging the additional award. The court of appeals denied the writ, concluding that Employer had waived a central issue in its mandamus action by not raising it during proceedings before the Commission. The Supreme Court reversed and ordered a limited writ of mandamus ordering the Commission to determine whether Employer knew or should have known about the latent defect at the time that Employee was injured, holding (1) waiver did not apply in this case because the central issue raised in Employer’s mandamus action was not raised by the parties below; and (2) if Employer lacked the requisite knowledge of a design defect at the time of the injury, it cannot have violated a specific safety requirement. State ex rel. Ohio Presbyterian Retirement Servs., Inc. v. Industrial Commission
The Supreme Court issued a writ of mandamus ordering the Industrial Commission to vacate its award to Employee of permanent-partial-disability compensation under Ohio Rev. Code 4123.57(A) and to issue an order denying the award, holding that, pursuant to State ex rel. Ohio Presbyterian Retirement Services, Inc. v. Industrial Commission (“Ohio Presbyterian I”), 79 N.E.3d 522 (Ohio 2016), when an injured employee is receiving permanent-total-disability compensation pursuant to Ohio Rev. Code 4123.58, the Commission is without statutory authority to grant in the same claim permanent-partial-disability compensation under section 4123.57(A). Employee in this case moved the court to reconsider its holding in Ohio Presbyterian I. The Supreme Court granted the motion, reopened the case for further consideration, and concluded that its holding in Ohio Presbyterian I was not made in error. Because the Commission granted Employee permanent-total-disability compensation and then permanent-partial-disability compensation in the same claim, the Supreme Court issued a writ of mandamus ordering the Commission to vacate its award of permanent-partial-disability compensation to Employee under section 4123.57(A) and to issue an order denying the award. Carrera v. Olmstead
Basilio Carrera lost his right hand in a workplace accident. The issue this accident presented for the Washington Supreme Court’s review was whether the Department of Labor and Industries (L&I) could pursue a third party claim for Carrera's injuries against Sunheaven Farms LLC, the contractor responsible for workplace safety at Carrera's job. The Washington Court affirmed the Court of Appeals' holding that L&I could pursue such a claim: statutes of limitations do not run against the sovereign when, as here, the State brought an action in the public interest. Benefit to a private party in addition to that state interest does not strip a state action of its sovereign character. Here, L&I's claim stands to benefit the State by reimbursing the medical aid fund (Fund) and furthering public policy goals; it is therefore exempt from the statute of limitations under RCW 4.16.160. The Court of Appeals also correctly interpreted chapter 51.24 RCW as authorizing L&I to recover damages beyond what it may retain. View "Carrera v. Olmstead" on Justia Law
Rueda v. Utah Labor Commission
In this splintered opinion, two justices would affirm in part and reverse in part the final order of the Labor Commission, two justices would affirm, and one justice would vacate and remand. Therefore, the order the Commission stood as issued. Appellee claimed workers’ compensation benefits against her employer for injuries she sustained while working. Appellee’s employer and its insurers initially paid Appellee’s benefits but later concluded that Appellee’s condition did not constitute a compensable accident under the Workers’ Compensation Act but was rather an occupational disease under the Occupational Disease Act. An administrative law judge (ALJ) disagreed and found in favor of Appellee, concluding that the employer was subject to ongoing liability for Appellee’s injuries, which were caused by a workplace accident under a theory of “cumulative trauma.” The Commission upheld the ALJ’s decision in its final order. In dispute in this opinion was the effect of the 1991 amendments to the Occupational Disease Act on the Workers’ Compensation Act. View "Rueda v. Utah Labor Commission" on Justia Law
Boyce v. State ex rel. Department of Workforce Services
The Supreme Court affirmed the district court’s affirmance of the decision of the Medical Commission, which upheld the Wyoming Workers’ Compensation Division’s denial of benefits to James Boyce. Boyce suffered an inguinal hernia while working. Boyce received workers’ compensation benefits to cover that injury, but the Division denied benefits for subsequently discovered conditions in Boyce’s lumbar spine. The Supreme Court agreed with the decisions below, holding that the Medical Commission did not act unreasonably or contrary to the overwhelming weight of the evidence in rejecting the opinion of Boyce’s medical expert and concluding that Boyce failed to prove that his work injury caused his need for subsequent spinal surgery. T.D. v. Patton
Kelcey Patton, a social worker for the Denver Department of Human Services (“DDHS”), was one of those responsible for removing T.D., a minor at the time, from his mother’s home, placing him into DDHS’s custody, and recommending T.D. be placed and remain in the temporary custody of his father, Tiercel Duerson. T.D. eventually was removed from his father’s home after DDHS received reports that T.D. had sexual contact with his half-brother, also Mr. Duerson’s son. DDHS later determined that during T.D.’s placement with Mr. Duerson, T.D. had suffered severe physical and sexual abuse at the hands of his father. T.D. sued Patton under 42 U.S.C. 1983 for violating his right to substantive due process, relying on a “danger-creation theory,” which provided that “state officials can be liable for the acts of third parties where those officials created the danger that caused the harm.” Patton moved for summary judgment on the ground that she is entitled to qualified immunity. The district court denied the motion. Finding no reversible error in that decision, the Tenth Circuit affirmed. View "T.D. v. Patton" on Justia Law
