Alaska Airlines, Inc. v. Darrow
An employee continued to work for over ten years after a job-related knee injury but had multiple surgeries on her injured knee. Over time, her employer made several permanent partial impairment payments, and she was eventually determined to be permanently and totally disabled because of the work injury. She began to receive Social Security disability at about the same time she was classified as permanently and totally disabled for workers’ compensation. Her employer asked the Alaska Workers’ Compensation Board to allow two offsets to its payment of permanent total disability (PTD) compensation: one related to Social Security disability benefits and one related to the earlier permanent partial impairment (PPI) payments. The Board established a Social Security offset and permitted the employer to deduct the amount of previously paid PPI. The employee appealed to the Alaska Workers’ Compensation Appeals Commission, arguing that the Board had improperly applied one of its regulations in allowing the PPI offset and had incorrectly calculated the amount of the Social Security offset. She also brought a civil suit against the State challenging the validity of the regulation. The State intervened in the Commission appeal; the lawsuit was dismissed. The Commission reversed the Board’s calculation of the Social Security offset and affirmed the Board’s order permitting the PPI offset. The employer appealed the Commission’s Social Security offset decision to the Alaska Supreme Court, and the employee cross- appealed the PPI offset. The Court affirmed that part of the Commission’s decision reversing the Board’s calculation of the Social Security disability offset and reversed that part of the Commission’s decision permitting an offset for permanent partial impairment benefits. Ex parte Alabama Department of Corrections.
The Alabama Department of Corrections ("ADOC") petitions this Court for a writ of mandamus directing the Montgomery Circuit Court to enter an order dismissing, on the ground of sovereign immunity the claims asserted against it by Jean and Scott Clowers. Jean Clowers sued ADOC, Isabella Cowan, and fictitiously named parties, seeking to recover damages for injuries she alleges she sustained as a result of a collision between a vehicle she was driving and an ADOC van driven by Cowan, who, at the time of the accident, was a work-release inmate in the custody of ADOC. Clowers alleged in her complaint that ADOC was vicariously liable for Cowan's alleged negligence and/or wantonness in running a red light and thus causing the accident. Clowers's husband, Scott, joined the action, claiming damages for loss of consortium. The Alabama Supreme Court determined ADOC established a clear legal right to the relief requested. Accordingly, the Court granted the petition for the writ of mandamus and directed the circuit court to dismiss the claims against ADOC based on the doctrine of sovereign immunity. Barrios v. Zing, LLC
While employed by Zing LLC, Josue Barrios (“Claimant”) was totally and permanently disabled as a result of an industrial accident when he fell about twelve feet from a ladder and hit his head face first on a concrete floor. He suffered multiple facial fractures, a frontal bone fracture, the loss of sight in his left eye, and a severe traumatic brain injury that caused a major neurocognitive disorder and speech language deficits. This case was an appeal of an Industrial Commission order requiring an employer and its surety to pay the cost of a guardian and a conservator for Barrios. John Doe #1 v. Indiana Department of Child Services
When an individual reported child abuse, the Indiana Department of Child Services (DCS) told the reporter that his report was confidential. The Department however, released the report without redacting the identity of the reporter. The reporter and his family sued DCS for negligently disclosing the reporter’s identity, claiming that the statute requiring DCS to protect reporter identity - Ind. Code 31-33-18-2 (section 2) - implies a private right of action and that DCS created a common-law duty of confidentiality. The trial court granted summary judgment for DCS. The court of appeals reversed, concluding that DCS owed Plaintiffs a common-law “private duty” based on a hotline worker’s “promise” of confidentiality. The Supreme Court granted transfer, thereby vacating the Court of Appeals decision, and held (1) section 2 provides no private right of action; and (2) there is no common law basis to impose a duty on DCS. Blaine v. Downtown Redevelopment Authority, Inc.
The Supreme Court affirmed the judgment of the Court of Appeals affirming the decision of the Workers’ Compensation Board in this workers’ compensation case. Appellant suffered a work-related injury in 2007. After she returned to work, Appellant suffered a second work-related injury in 2011 that resulted in Appellant being found permanently totally disabled. At issue before the Supreme Court was the proper disposition of Appellant’s claim for benefits following her first injury. The Board remanded the matter to the administrative law judge, determining that the ALJ erred in concluding that Appellant had not claimed entitlement to permanent total disability benefits following her first injury. The Board remanded this case to the ALJ with specific instructions to first determine Appellant’s entitlement to permanent total disability benefits and, if she was not entitled to such benefits, to determine her permanent partial disability benefits using a proper analysis under Fawbush v. Gwinn, 103 S.W. 3d 5 (Ky. 2005). The Court of Appeals affirmed. The Supreme Court affirmed, holding that the Court of Appeals did not err in its judgment. View "Blaine v. Family Dollar v. Baytos
Steven Baytos settled his workers’ compensation injury claim with Family Dollar Stores, his employer. The settlement amount included separate consideration in exchange for Baytos’s waiver of all future claims. Two years after Baytos died from his work-related injury, Mamie Baytos, his widow who was not a party to the settlement, filed a motion to reopen Baytos’s injury claim to assert her own claim for a workers’ compensation death benefit. The administrative law judge allowed Mamie to reopen Baytos’s claim and awarded her death benefits. The Workers’ Compensation Board reversed, concluding that claims for death benefits arising from a workers’ compensation injury are not derivative of the income benefits the injured employee recovers from the employer. The Court of Appeals reversed the Board. The Supreme Court affirmed, holding (1) Mamie has a separate and viable claim for death benefits under Ky. Rev. Stat. 342.750; and (2) it was improper for Mamie to assert her claim via reopening Baytos’s settled claim, although the court made an exception in today’s case. View "Family Dollar v. Board of Commissioners of Union County v. McGuinness
The Supreme Court affirmed the judgment of the trial court dismissing this action brought by the Board of Commissioners of Union County (Union County) seeking a declaratory judgment and an injunction against the Commissioner of the Indiana Department of Transportation and the Department itself (collectively, INDOT). In the action, Union County alleged that INDOT was negligent in its highway repair efforts, causing damage to the septic systems of three landowners in Union County. The trial court granted INDOT's motion to dismiss, concluding that Union County did not have standing to sue INDOT for injury done to its residents. The Supreme Court affirmed, holding that the trial court did not err in dismissing the action because Union County failed to plead any viable theory of standing to support its alleged cause of action. Kebschull v. State ex rel. Department of Workforce Services, Workers’ Compensation Division
The Supreme Court affirmed the Medical Commission’s denial of additional temporary total disability benefits to Appellant. The Commission denied benefits after a contested case hearing, concluding that Appellant’s persistent back problems were the result of a preexisting degenerative condition and that Appellant failed to establish an increase in incapacity to a reasonable degree of medical certainty due solely to a work injury. The district court upheld the Commission’s decision. The Supreme Court affirmed, holding (1) there was substantial evidence to support the Commission’s conclusion that Appellant was not entitled to benefits under Wyo. Stat. Ann. 27-14-605; (2) the Commission did not misapply the second compensable injury rule; and (3) there was substantial evidence to support the Commission’s conclusion that Appellant did not suffer a second compensable injury. Reger v. Washington County Board of Education
The Court of Appeals affirmed the finding of the Workers’ Compensation Commission (WCC) that Employer and Insurer (collectively, Respondents) were entitled to offset the ordinary disability benefits already paid to Petitioner against the temporary total disability benefits paid to him by Respondents.Petitioner suffered injuries primarily to his back and neck while working for Employer. Employer received two different sets of disability benefits from Employer and Insurer, each awarded by a different state agency. Specifically, Petitioner was granted temporary total disability benefits by the WCC and ordinary disability benefits by the State Retirement Agency. The WCC found that Respondents were entitled to a credit for the ordinary disability benefits already paid to Petitioner. On judicial review, the circuit court granted summary judgment in favor of the WCC. The Court of Appeals affirmed, holding that because both sets of benefits compensated Petitioner for the same injury, pursuant to Md. Code Ann.
