Plaintiff and her husband filed suit under the Federal Tort Claims Act (FTCA), 28 U.S.C. 1346(b)(1), 2671-2680, against the government after she suffered severe injuries in her diplomatic housing when stationed overseas in Haiti. The DC Circuit affirmed the district court's dismissal of the suit because plaintiffs' action fell within an exception to the FTCA's waiver of sovereign immunity for injuries arising in a foreign country. Even assuming without deciding that all overseas diplomatic housing should receive the same treatment under the FTCA as a United States embassy, plaintiffs' claim was foreclosed by circuit precedent. Plaintiff was injured while working for Defendant. The North Carolina Industrial Commission accepted Plaintiff’s claim as compensable under the Workers’ Compensation Act, and Defendant began paying Plaintiff compensation for temporary total disability. Plaintiff later filed a Form 33 requesting a medical motion hearing regarding his symptoms. The Commission concluded that Plaintiff failed to meet his burden of establishing that his anxiety and depression were a result of his work-related accident and that Plaintiff was not entitled to disability payments made after January 2011. The court of appeals (1) vacated and remanded in part, ruling that, on remand, the Commission should give Plaintiff the benefit of a presumption that his anxiety and depression were related to his injuries; and (2) reversed in part, ruling that Plaintiff had met his burden of establishing disability. The Supreme Court affirmed as modified and remanded for further proceedings, holding (1) Plaintiff was entitled a presumption of compensability in regard to his continued medical treatment; and (2) the Commission failed to address the effects of Plaintiff’s tinnitus in determining whether Plaintiff lost wage-earning capacity. A provision of the mandatory form settlement document promulgated by the Director of the Division of Workers’ Compensation (“Director”) did not waive an injured employee’s statutory right under section 8-43-204(1), C.R.S. (2016), to reopen a settlement based on a mutual mistake of material fact. Petitioner Victor England was a truck driver for Amerigas Propane. He filed a workers’ compensation claim after sustaining a serious injury to his shoulder in December 2012 while making a delivery for Amerigas. England’s claim was governed by the Colorado Workers’ Compensation Act, which required that settlements between employer and employee must be written, signed by both sides, and approved by the Director or an administrative law judge (“ALJ”). Pursuant to section 8-43-204, the Director promulgated a form settlement agreement (“Form”), which the parties are required to use to settle all claims. In this case, the parties’ settlement agreement was consistent with the Form. England’s pain continued after the settlement agreement was signed and approved. In October 2013, he sought further medical evaluation, which revealed a previously undiagnosed stress fracture in the scapula (shoulder blade) of England’s injured shoulder. Up to this point, no one was aware that this fracture existed. England claims that if he had been aware of this fracture, he would not have settled his claim. England filed a motion to reopen the settlement on the ground that the newly discovered fracture justified reopening his workers’ compensation claim. An ALJ agreed, and the Industrial Claim Appeals Office (ICAO) affirmed. The court of appeals reversed, concluding that the Form waived England’s right to reopen. The Colorado Supreme Court held that because provisions of the form document must yield to statutory rights, the court of appeals erred in its conclusion. View "England v. Following the suicide death of her 14-year-old daughter, Appellee Laura Lane Maia sued the mayor and city council of the City of Richmond Hill (collectively, “the City”) and Douglas Sahlberg, individually and in his capacity as an officer with the Richmond Hill Police Department (collectively “Appellants”), alleging wrongful death and associated claims. Appellee’s daughter, Sydney Sanders, attempted suicide by cutting herself in the neck, chest, and abdomen, and she was subsequently taken to the hospital for medical treatment. Officers with the Richmond Hill Police Department (“RHPD”), including Officer Sahlberg, responded to the hospital to investigate, and Sanders’s injuries were photographed by the officers. Sahlberg accessed those photographs on his work computer and showed them to his daughter, K.S., who was a classmate of Sanders; shortly thereafter, K.S. was seen using her cell phone to show the images to other classmates. Sanders was distraught and mortified to discover that the photographs had been shared. In her complaint, Appellee averred (inter alia): that Salhberg had a duty to keep the injury photographs confidential; that he had breached that duty; that Sahlberg should have known that the publication of the photographs created a reasonable apprehension that Sanders would further harm herself; and that Sanders’s death was caused by Sahlberg’s negligent conduct. Appellants moved for summary judgment, asserting that Appellee could not demonstrate causation because, under Georgia law, suicide was generally an independent act which breaks the chain of causation from the events preceding the death. The trial court denied the motion with a one-page order and granted a certificate of immediate review. A divided Court of Appeals affirmed, concluding that, because “Sanders’s suicide was a reasonably foreseeable consequence of Sahlberg’s negligent conduct, [Sanders’s] act of suicide was not an intervening act that would preclude Sahlberg’s breach of duty from constituting the proximate cause of that injury.” The Supreme Court concluded Appellee could not demonstrate proximate cause and therefore reversed the Court of Appeals. Steven Andrews filed for workers’ compensation benefits after he fell from a ladder in 2009 while working for the Corporation of the Church of Jesus Christ of Latter Day Saints (LDS Church). Andrews sought to establish that the Idaho Industrial Special Indemnity Fund (ISIF) was liable pursuant to Idaho Code section 72- 332. The referee concluded that Andrews failed to show that ISIF was liable because the evidence showed that any pre-existing physical impairments did not constitute a subjective hindrance and that Andrews failed to show that his pre-existing impairments combined with the industrial accident to cause his total and permanent disability. The Commission adopted the recommendation. Andrews timely appealed, arguing that the Commission’s order was not supported by substantial and competent evidence. Margaret Hulgan tripped and fell at a Fourth of July celebration at a City of Guntersville-owned Civitan Park. She sued the City, and the City claimed immunity under Alabama recreational-use statutes. The trial court denied the City’s motion to dismiss, and the City appealed. Finding that the City demonstrated it had a clear legal right to immunity, and that Hulgan failed to present substantial evidence to overcome the City’s right to immunity, the Alabama Supreme Court granted the City mandamus relief, and ordered the trial court to enter summary judgment in favor of the City. Morris Blackburn worked as a coal miner for twenty years, exposed to dust in an Energy West coal mine. He also smoked cigarettes, and eventually developed a respiratory disease. Based on this disease, Blackburn claimed benefits under the Black Lung Benefits Act. Energy West challenged the award of benefits, arguing Blackburn caused his disease by smoking cigarettes. The Department of Labor’s Benefits Review Board affirmed an award of compensation, and Energy West appealed. The Tenth Circuit found no reversible error in the award of benefits, and affirmed. A non-negligently constructed and maintained piece of playground equipment cannot be a “dangerous condition” under the Colorado Governmental Immunity Act’s recreation-area waiver. Nine-year-old Alexa Loveland fell while using her elementary school playground’s zip line apparatus and severely fractured her wrist and forearm. Alexa and her parents filed a tort action against the school district, seeking damages for Alexa’s injuries. Because the Colorado legislature limited when public entities such as the school district may be sued, the issue this case presented for the Colorado Supreme Court’s review was whether the Lovelands’ lawsuit fell within one of the limited exceptions to sovereign immunity under the Act. The Supreme Court concluded the facts as the Lovelands have alleged them, did not satisfy the dangerous-condition requirement, and that the trial court was correct to conclude the recreation-area waiver did not apply. In 2009, Richard Mattox sued the Department of Corrections (DOC) for injuries arising from an assault by another prisoner. Mattox alleged that DOC was negligent in failing to accommodate his requests for transfer to a different housing module prior to the assault and that DOC was negligent in permitting the correctional officer on duty to leave the module during the time the assault occurred. The superior court granted DOC’s motion for partial summary judgment regarding classification and housing assignments and then granted DOC’s motion for summary judgment on all other causes of action. The Alaska Supreme Court remanded because there was a material question of fact regarding the foreseeability of the assault. Mattox moved for a new trial on the grounds that the jury erroneously applied the doctrine of discretionary function immunity in reaching its verdict when that question should have been decided by the court before trial. The court denied that motion and Mattox appealed. The Supreme Court concluded Mattox waived any challenge to the jury’s application of the doctrine, and the superior court committed no reversible error by allowing the jury to apply the doctrine rather than applying the doctrine itself sua sponte. Plaintiff, who was paralyzed in an accident during a work accident, filed a petition seeking a determination of permanent total disability (PTD) and also sought partial commutation of benefits in a lump sum. Defendant, the workers’ compensation insurer, disputed whether Plaintiff was PTD and resisted the commutation, although it continued to pay full weekly PTD benefits and explore settlement. The Iowa Workers’ Compensation Commissioner granted Plaintiff’s petition for partial commutation. Plaintiff then sued Defendant for first-party bad faith. On summary judgment, the district court determined that Defendant acted in bad faith. The jury awarded punitive and compensatory damages at a ratio of 88:1. The Supreme Court (1) reversed the judgments for compensatory and punitive damages, holding that, while Defendant knew or should have known it lacked any reasonable basis to dispute Plaintiff’s PTD status, the district court erred in ruling that Defendant was in bad faith as a matter of law for resisting the commutation; and (2) the district court properly denied Plaintiff an award of attorney fees incurred in prosecuting the bad-faith action.
