PEOPLE FOR THE ETHICAL TREATMENT OF ANIMALS VS. BOARD OF SUPERVISORS OF LOUISIANA STATE UNIVERSITY

United States v. Huazhi Han
The case revolves around Huazhi Han, who was convicted on charges of money laundering and related offenses. HENSLEY v. STATE COMMISSION ON JUDICIAL CONDUCT

AMMONITE OIL & GAS CORPORATION v. RAILROAD COMMISSION OF TEXAS
The case involves Ammonite Oil & Gas Corporation (Ammonite) and the Railroad Commission of Texas and EOG Resources, Inc. (EOG). Ammonite leases mineral rights beneath a riverbed from the State of Texas. EOG leases the minerals on the land adjoining the river on both sides. All the minerals in the area lie in a common subsurface reservoir. EOG's wells, however, do not reach the minerals beneath the riverbed. Ammonite applied to the Railroad Commission for forced pooling under the Texas Mineral Interest Pooling Act (MIPA).The Railroad Commission rejected Ammonite's applications to force-pool the minerals beneath the river—which are not being produced—with those beside it—which are. The lower courts affirmed the Commission’s order. The Supreme Court of Texas also affirmed the lower courts' decisions but for different reasons than the court of appeals gave.The Supreme Court of Texas held that the Commission’s conclusion that “Ammonite failed to make a fair and reasonable offer to voluntarily pool as required by [MIPA Section] 102.013” is reasonable. The court also held that Ammonite has failed to show that forced pooling of its acreage with EOG’s wells is necessary to prevent its minerals from ultimately being lost. The court concluded that Ammonite applied for a share of EOG’s revenue without contributing to it and that the Commission’s conclusion that forced pooling would not prevent waste or protect correlative rights is not unreasonable. El Koussa v. Attorney General

United States ex rel. Angelo v. Allstate Insurance Co.

SAN CARLOS APACHE TRIBE v STATE
The case involves the San Carlos Apache Tribe's challenge to the Arizona Department of Environmental Quality's (ADEQ) issuance of a 2017 Permit Renewal to Resolution Copper Mining, LLC (Resolution) for the discharge of water from a copper mine. The Tribe argued that the construction of a new mine shaft (Shaft 10) and other new features at the mine constituted a "new source" under the Clean Water Act (CWA), which would subject the mine to more stringent regulations.Previously, an administrative law judge (ALJ) had determined that ADEQ should have analyzed whether Shaft 10 and the other new features were a "new source" under the CWA before issuing the permit. The Arizona Water Quality Appeals Board remanded the matter to ADEQ, which concluded that Shaft 10 and the new features were "existing sources" under the CWA. The Board affirmed ADEQ's issuance of the 2017 Permit Renewal. The Tribe appealed to the superior court, which affirmed the Board's decision. The court of appeals reversed, concluding that Shaft 10 was a "new source" under the CWA.The Supreme Court of the State of Arizona disagreed with the court of appeals. The court applied a three-step test to determine whether a construction is a "new source" under the CWA. The court found that Shaft 10 was not a "new source" under the CWA because it was integrated with existing infrastructure at the mine and engaged in the same general type of activity as the existing source. The court also found that Shaft 10 did not have a new source performance standard "independently applicable" to it. Therefore, the court concluded that ADEQ acted within its discretion by issuing the 2017 Permit Renewal to Resolution. Ohio v. Environmental Protection Agency
The Clean Air Act envisions a collaborative effort between states and the federal government to regulate air quality. When the Environmental Protection Agency (EPA) sets standards for common air pollutants, states must submit a State Implementation Plan (SIP), providing for the implementation, maintenance, and enforcement of those standards in their jurisdictions. In 2015, the EPA revised its air-quality standards for ozone, triggering a requirement for states to submit new SIPs. Years later, the EPA announced its intention to disapprove over 20 SIPs because the agency believed they had failed to address adequately obligations under the Good Neighbor Provision. During the public-comment period for the proposed SIP disapprovals, the EPA issued a single proposed Federal Implementation Plan (FIP) to bind all those states.The D.C. Circuit denied relief to a number of the remaining states and industry groups who challenged the FIP, arguing that the EPA’s decision to apply the FIP after so many other states had dropped out was “arbitrary” or “capricious.” They asked the court to stay any effort to enforce the FIP against them while their appeal unfolded. The parties renewed their request in the Supreme Court of the United States.The Supreme Court granted the applications for a stay, halting enforcement of the EPA’s rule against the applicants pending the disposition of the applicants’ petition for review in the D.C. Circuit and any petition for writ of certiorari, timely sought. The Court found that the applicants were likely to prevail on their claim that the EPA’s action was arbitrary or capricious because the agency failed to offer a satisfactory explanation for its action, including a rational connection between the facts found and the choice made, and ignored an important aspect of the problem.
